Under a final rule just published in the Federal Register, the Centers for Medicare & Medicaid Services announced that the claims data related to Medicare Part D dating back to Jan. 1, 2006, will be soon become available to the Secretary of Health & Human Services as well as external sources for research and public health purposes. Privacy protections will be maintained for the data so that patient identities will not be revealed. CMS had proposed this rule back in Oct. 18, 2006, and received close to 120 comments from pharmacies, researchers, and others. This final rule, which takes effect on June 27, incorporates the comments from these sources.
